1. Acceptance of Terms

By accessing or using Contact Orbit ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Description of Service

Contact Orbit is a customer management and SMS automation platform designed for IPTV providers. The Platform provides the following services:

  • Customer database management and tracking.
  • Subscription and payment management.
  • Automated SMS notifications via third-party providers.
  • Reporting and analytics dashboards.

3. Account Registration

To use the Platform, you must:

  • Register for an account with accurate and complete information.
  • Be at least 18 years of age.
  • Maintain the security and confidentiality of your login credentials.
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Platform to:

  • Send unsolicited or spam SMS messages.
  • Violate any applicable laws, regulations, or third-party rights.
  • Transmit harmful, threatening, abusive, or unlawful content.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the Platform's infrastructure.
  • Use the Platform for any fraudulent or deceptive purposes.

5. SMS Messaging Compliance

You are solely responsible for ensuring that all SMS messages sent through the Platform comply with applicable laws and regulations, including but not limited to:

  • The Telephone Consumer Protection Act (TCPA).
  • The CAN-SPAM Act.
  • Any local or international telecommunications regulations.

You must obtain proper consent from recipients before sending SMS messages. We are not liable for any violations resulting from your use of our SMS features.

6. Data Ownership

You retain ownership of all customer data, templates, and content you upload to the Platform. By using the Platform, you grant us a limited license to process and store this data solely for the purpose of providing our services to you.

7. Subscription Plans and Payments

  • Certain features of the Platform may require a paid subscription.
  • Subscription fees are billed in advance on a monthly basis.
  • All fees are non-refundable unless otherwise stated.
  • We reserve the right to modify pricing with 30 days' notice.
  • SMS usage beyond your plan's quota will be charged at the applicable overage rate.

8. Service Availability

We strive to maintain high availability of the Platform but do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance that temporarily affects availability. We are not liable for any downtime or service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided "as is" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount you paid for the Platform in the 12 months preceding the claim.
  • We are not responsible for SMS delivery failures caused by third-party providers or carrier issues.

10. Termination

We may suspend or terminate your access to the Platform at any time if you violate these Terms or for any other reason at our discretion. Upon termination:

  • Your right to access the Platform will cease immediately.
  • We may delete your account and associated data after a reasonable retention period.
  • You may request an export of your data before termination takes effect.

11. Indemnification

You agree to indemnify and hold harmless Contact Orbit, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Contact Orbit operates, without regard to conflict of law principles.
